1. Introduction

These Terms of Service ("Terms", "TOS") govern all services provided by SowfiHost https://www.sowfihost.com/ ("SowfiHost", "we", "us", or "our"). By purchasing, accessing, or using any SowfiHost service, you ("Customer", "you") confirm that you have read, understood, and agreed to be bound by these Terms and all related policies.

If you do not agree with any part of these Terms, you must not use our services.

3. Governing Law & Jurisdiction

SowfiHost operates exclusively under Indian law.

These Terms and any dispute arising from SowfiHost services shall be governed solely by the laws of India, without regard to conflict-of-law principles.

You agree that any legal proceedings shall be subject to the exclusive jurisdiction of courts located in India.

4. Services Provided

SowfiHost provides web hosting and related services to customers worldwide. These Terms exist to protect our infrastructure, customers, and service quality.

5. Resource Usage Policy

The Resource Usage Policy forms an integral part of this TOS and defines acceptable limits for CPU, memory, disk, and network usage.

Failure to comply may result in suspension, limitation, or termination of services.

6. Multiple Account Policy

Each customer is permitted to maintain only one SowfiHost account.

Creating multiple accounts for:

• Referral abuse
• Promotional exploitation
• Any unfair advantage

is strictly prohibited. Violations may result in account termination, loss of credits, commissions, and permanent service denial.

7. Acceptable Use & Content Policy

All SowfiHost services may be used for lawful purposes only.

You agree not to store, distribute, or transmit any content that violates Indian law or any applicable regulation. You further agree to indemnify and hold SowfiHost harmless from any claims resulting from your use of our services.

Prohibited Content & Activities (Non-Exhaustive)

The following are strictly prohibited:

1. Movie streaming, upload/download, or file-sharing sites
2. Pirated, cracked, nulled, GPL misuse, or illegally distributed software
3. Bulk email tools or spam-related services
4. Pornographic or sexually explicit content (including indirect or linked content)
5. Hacking, cracking, exploits, brute-force tools
6. Warez, copyrighted MP3s, videos, or media
7. Content illegal under Indian law
8. Criminal activities & Content threatening public safety (weapons, bombs, etc.)
9. CPU or resource-intensive applications
10. Denial-of-Service (DoS/DDoS) attacks
11. Account trading or resale
12. Spamming or unsolicited communications
13. File dumps, mirror services, or ad servers
14. Sale of controlled substances or online pharmacies
15. Autosurf, HYIP, investment, escrow abuse, lottery schemes
16. Cryptocurrency-related activities, including mining, trading platforms, crypto-jacking
17. Brute force tools, IP scanners, mail bombers
18. IRC on Shared or VPS servers (game servers allowed on VPS if compliant)

SowfiHost is the sole arbiter of what constitutes a violation and may suspend or terminate services without notice.

8. Storage Usage Policy

SowfiHost services are not intended for storage purposes.

You may not:

• Host video or music streaming websites
• Use hosting as a file storage system
• Use hosting for backups
• Upload multiple large unrelated files

Violations may result in immediate suspension or termination.

9. Copyright & DMCA Policy

SowfiHost complies with applicable copyright laws, including the DMCA. Valid infringement notices will be acted upon. Invalid or incomplete notices will be ignored.

10. System Resource Abuse

If an account consumes excessive system resources, SowfiHost may:

• Temporarily suspend the account
• Issue a 7-day eviction notice to upgrade or migrate

All cases are reviewed individually. SowfiHost's decision is final.

11. Backups & Data Responsibility

SowfiHost performs nightly backups for administrative purposes only.

⚠ Backups are NOT guaranteed.

Customers are fully responsible for maintaining their own backups. SowfiHost assumes no liability for data loss, corruption, or backup failure—even if caused by negligence.

12. Unsolicited Email (SPAM)

SPAM is strictly prohibited.

Violations result in immediate suspension. SowfiHost reserves the right to charge $90/hour for cleanup, investigation, and remediation.

13. Support Abuse

Abusive, rude, or demeaning behavior toward SowfiHost staff may result in suspension or termination with 10 days' notice.

14. Server Abuse & Security

Any attempt to compromise, disrupt, or damage SowfiHost infrastructure or customers is strictly prohibited and may result in immediate termination and reporting to authorities.

15. Cancellation Policy

All cancellations must be submitted via the Client Portal.

Required:

• Primary domain name
• Confirmation that backups have been downloaded

Only account owners may request cancellation.

16. Pricing Changes

SowfiHost reserves the right to change prices at any time without prior notice.

It is your responsibility to regularly review pricing and billing details. Continued use of services constitutes acceptance of updated pricing.

17. Late Payments & Non-Payment Policy

A. Domain Names

Domains become inactive immediately after the due date.

A 30-day grace period is provided for renewal.

If renewed within 30 days:

• Domain is reactivated
• Expiry date remains one year from original expiry, not renewal date

After 30 days:

• Redemption fees may apply
• Domain availability is not guaranteed

B. Hosting Services

Hosting is suspended immediately after the due date.

Hosting is terminated after 30 days of non-payment.

VPS Hosting will be terminated immediately after payment due date

After termination:

• All data is permanently deleted
• No recovery is possible

Data recovery during suspension requires payment of one (1) month hosting fee.

SowfiHost is not liable for data loss due to non-payment.

18. Free Domain Name Policy

Free domain registration is available only on selected hosting plans.

Conditions:

• Must be ordered during initial signup
• Free for first year only
• Renewal fees apply from second year
• Non-transferable and non-customizable

19. Money-Back Guarantee & Refund Policy

The 30-Day Money-Back Guarantee applies ONLY to Web Hosting.

Exclusions:

• Domains
• WordPress Hosting
• VPS / Dedicated Servers
• Renewals, upgrades, add-ons
• Setup or external service fees

Refunds are void if TOS violations occur.

Outside the guarantee, all payments are non-refundable.

Account credits:

• Non-refundable
• Valid for 2 years
• Forfeited if unused

20. Free Migration Policy

Free migration applies to:

• Web Hosting
• WordPress Hosting
• Reseller Hosting

Conditions:

• Request within 30 days
• One cPanel account included
• Additional migrations: $10 per cPanel account
• Domain transfers are excluded.

21. Enforcement & Termination

Failure to comply with these Terms may result in:

• Suspension
• Termination
• Content removal

SowfiHost reserves the right to terminate services with or without notice. Upon termination, no data will be retained.
